KURDSELECT TERMS OF SERVICE

Welcome to KurdSelect.

These Terms of Service, referred to as the "Terms," constitute a legally binding agreement between you and NHRHR Ventures LLC, a Texas limited liability company doing business as KurdSelect, referred to as "KurdSelect," "Company," "we," "us," or "our."

KurdSelect is a matchmaking and social connection platform available through mobile applications, websites, and related services, collectively referred to as the "Services."

NHRHR Ventures LLC is the legal entity operating KurdSelect. KurdSelect is an assumed name of NHRHR Ventures LLC registered in Texas.

By creating a KurdSelect account, accessing the Services, purchasing a subscription, or otherwise using KurdSelect, you agree to these Terms and acknowledge our Privacy Policy.

If you do not agree to these Terms, do not create an account or use KurdSelect.

You must be at least 18 years old to create an account or use KurdSelect.

By creating an account, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into these Terms
• You are legally permitted to use the Services
• You have not been prohibited from using KurdSelect
• You will comply with these Terms and applicable laws
• Information you provide is materially accurate and not intentionally misleading

KurdSelect may request reasonable information or verification where necessary to confirm eligibility, protect users, prevent fraud, or comply with applicable law.

We reserve the right to refuse, suspend, restrict, or terminate accounts that do not satisfy these requirements.

KurdSelect is designed to help adults discover, connect, and communicate with other members for matchmaking, dating, relationship, and social connection purposes.

KurdSelect does not guarantee that you will find a match, relationship, spouse, partner, friendship, or any particular result from using the Services.

KurdSelect does not conduct itself as a marriage broker, professional counselor, therapist, background investigation agency, or guarantor of any user's identity, character, intentions, statements, conduct, compatibility, or safety.

You are solely responsible for deciding whether and how to interact with another member.

Certain KurdSelect features require an account.

You agree to provide accurate information and keep information reasonably current.

You may not:

• Create an account for another person without authorization
• Impersonate another person
• Intentionally misrepresent your identity
• Create deceptive or fraudulent profiles
• Create multiple accounts to evade restrictions or enforcement
• Buy, sell, transfer, or share accounts without our authorization
• Use another person's account without permission
• Create a new account after being banned without written authorization

You are responsible for maintaining the security of your account and credentials.

Notify us promptly if you believe your account has been accessed without authorization.

KurdSelect allows users to create profiles and submit content.

"User Content" may include:

• Photographs
• Profile descriptions
• Biographical information
• Interests
• Relationship preferences
• Messages
• Communications
• Reports
• Other information or materials submitted through the Services

You retain ownership of User Content that you lawfully own.

However, by submitting User Content to KurdSelect, you grant NHRHR Ventures LLC a nonexclusive, worldwide, royalty free, transferable and sublicensable license to host, store, reproduce, display, format, adapt, process, transmit, and otherwise use that User Content to the extent reasonably necessary to operate, secure, improve, promote, and provide the Services.

This license does not give KurdSelect ownership of your User Content.

To the extent reasonably practicable, the license ends when your User Content is deleted from our active systems, except where continued retention or processing is reasonably necessary for backups, safety, fraud prevention, legal compliance, dispute resolution, enforcement, or other lawful purposes.

You represent that you have the necessary rights and permissions to submit User Content.

Profile photographs must comply with KurdSelect policies.

You may not knowingly upload:

• Photographs you do not have permission to use
• Photographs intended to impersonate another person
• Fraudulent or materially deceptive photographs
• Explicit pornography
• Illegal content
• Content exploiting minors
• Content promoting violence or terrorism
• Content that violates another person's intellectual property or privacy rights

KurdSelect may remove photographs or other content that violates these Terms or our policies.

You may not use KurdSelect to engage in unlawful, harmful, deceptive, abusive, exploitative, or dangerous conduct.

Prohibited conduct includes:

• Harassment
• Bullying
• Stalking
• Threats
• Hate based abuse
• Sexual harassment
• Nonconsensual sexual content
• Exploitation
• Human trafficking
• Solicitation of prostitution or unlawful sexual services
• Child sexual exploitation or abuse
• Fraud
• Romance scams
• Financial scams
• Phishing
• Extortion or blackmail
• Impersonation
• Identity theft
• Spam
• Unauthorized commercial solicitation
• Distribution of malware
• Attempts to compromise accounts or systems
• Promotion of illegal activity
• Encouraging violence
• Sharing another person's private information without authorization
• Circumventing blocks, bans, or enforcement measures

KurdSelect may investigate suspected violations and take appropriate action.

Google specifically requires UGC platforms to define objectionable behavior and maintain effective moderation, reporting, and blocking mechanisms.

KurdSelect is strictly for adults age 18 and older.

Any content or conduct involving child sexual exploitation or abuse is strictly prohibited.

Users may not:

• Create accounts while under 18
• Create profiles representing minors
• Sexually exploit or solicit minors
• Share sexual content involving minors
• Groom or attempt to exploit minors
• Use KurdSelect to facilitate unlawful contact with minors

KurdSelect may immediately terminate accounts associated with suspected child exploitation and may preserve or report information to appropriate authorities where required or permitted by law.

KurdSelect is a matchmaking platform and is not intended to be a pornography or sexually explicit content service.

Users may not publicly post pornographic or sexually explicit content.

KurdSelect may remove content or restrict accounts that violate these standards.

Apple specifically identifies UGC services used primarily for pornographic content, anonymous chat, threats, bullying, or similar abuse as unsuitable for the App Store.

KurdSelect provides or intends to provide mechanisms allowing users to report inappropriate users or content and block other users.

The development specification includes both user reporting and blocking functionality.

When you block another user, certain interactions between the accounts may be restricted.

When you submit a report, you agree to provide information in good faith.

Submitting intentionally false or abusive reports may itself violate these Terms.

KurdSelect may investigate reports but does not guarantee that every report will result in suspension or termination.

We may determine appropriate enforcement based on available information, applicable law, safety considerations, and our policies.

KurdSelect may, but is not obligated to, review, monitor, investigate, restrict, remove, or preserve User Content or account activity where reasonably necessary to:

• Enforce these Terms
• Investigate reports
• Protect users
• Prevent fraud
• Maintain security
• Comply with law
• Respond to legal process
• Protect KurdSelect or third parties

We may use human review, technical systems, automated systems, or combinations of these methods.

KurdSelect may take actions including:

• Issuing warnings
• Removing content
• Limiting features
• Restricting visibility
• Suspending accounts
• Terminating accounts
• Preventing creation of replacement accounts

We are not required to disclose internal fraud detection, moderation, security, or enforcement techniques where doing so could compromise their effectiveness or user safety.

KurdSelect allows eligible members to communicate with other members.

According to KurdSelect's current product design, Premium members may initiate messages without requiring a mutual match, and access to messages and related functionality may depend upon subscription status.

You are responsible for communications you send.

Do not send another member threatening, abusive, fraudulent, sexually exploitative, illegal, or otherwise prohibited communications.

A user's ability to contact another member does not mean that KurdSelect endorses, verifies, recommends, or guarantees that user.

KurdSelect does not control what users do outside the Services.

Meeting another person whom you first encountered online carries inherent risks.

You are responsible for evaluating whether to communicate with or meet another member.

Consider reasonable safety precautions before meeting someone, including meeting in a public location, telling someone you trust where you are going, arranging your own transportation, and protecting sensitive personal and financial information.

Never send money or financial credentials to someone merely because you met them through KurdSelect.

KurdSelect is not responsible for the conduct of users before, during, or after an offline interaction to the fullest extent permitted by applicable law.

Nothing in these Terms excludes liability that cannot legally be excluded.

Unless KurdSelect expressly states otherwise for a particular feature, KurdSelect does not guarantee that users have undergone criminal, identity, sex offender, employment, immigration, marital status, financial, or other background checks.

Even if KurdSelect implements verification features, verification does not guarantee that a person is safe, trustworthy, truthful, single, compatible, or free from criminal history.

You remain responsible for exercising reasonable judgment when interacting with others.

KurdSelect may provide limited functionality without a paid subscription.

Under the current KurdSelect model, free users may create and edit an account and profile, upload and manage photographs, and appear within the member database.

Certain other features may require Premium access.

KurdSelect may modify free features over time, subject to applicable law.

KurdSelect offers or intends to offer Premium subscriptions.

Premium features may include:

• Browsing members
• Searching and filtering
• Viewing full profiles
• Liking members
• Sending messages
• Reading messages
• Replying to messages
• Starting conversations
• Seeing who liked you
• Seeing who viewed your profile

Current planned subscription periods include:

• 1 Month
• 3 Months
• 6 Months

The development documentation confirms these subscription periods and the premium functionality.

Actual pricing will be displayed before purchase and may vary by country, currency, platform, taxes, promotions, or other factors.

KurdSelect subscriptions may automatically renew unless canceled before the applicable renewal date.

By purchasing an automatically renewing subscription, you authorize the applicable payment provider to charge the payment method associated with your account at the displayed price and billing interval until the subscription is canceled.

Before purchasing, you will be shown applicable pricing, billing frequency, and other material subscription information.

Google requires subscription offers to clearly disclose cost, billing frequency, automatic renewal terms, whether a subscription is required, and other material terms.

Subscriptions purchased through the Apple App Store generally must be managed or canceled through your Apple account.

Subscriptions purchased through Google Play generally must be managed or canceled through your Google Play account.

Deleting your KurdSelect account does not automatically guarantee cancellation of a subscription managed by Apple or Google.

Similarly, canceling your subscription does not automatically delete your KurdSelect account.

Cancellation generally prevents future renewals but does not necessarily terminate access immediately. Access may continue until the end of the paid subscription period, subject to applicable platform rules and law.

KurdSelect will provide appropriate subscription management information within the Services as required.

Google currently requires subscription apps to provide users an easy online method to manage or cancel subscriptions.

Purchases made through Apple or Google are subject to the applicable marketplace's billing, cancellation, and refund policies.

Except where required by applicable law or expressly provided by the applicable payment provider, subscription charges are generally nonrefundable once charged.

Nothing in these Terms eliminates refund or cancellation rights that cannot legally be waived.

KurdSelect may change subscription pricing, features, or plans from time to time.

Price changes affecting existing subscribers will be implemented subject to applicable law and the requirements of the applicable app marketplace.

Where required, affected users will receive advance notice and an opportunity to cancel before a new price becomes effective.

Google specifically requires developers using certain subscription price increase mechanisms to reserve the right to increase prices with advance notice and provide clear reasons for increases.

KurdSelect may notify users of genuine activity involving their account, including likes, profile views, and messages.

Some information may remain unavailable until a user obtains the applicable subscription.

For example, a free member may receive notice that another member has expressed interest or sent a message while Premium access is required to access certain details or functionality. This is part of KurdSelect's documented subscription model.

KurdSelect does not authorize fabricated user activity for the purpose of misleading users into purchasing subscriptions.

Notification wording, availability, and features may change as the Services evolve.

Purchasing KurdSelect Premium provides access to specified features.

It does not purchase or guarantee attention, responses, dates, matches, relationships, marriage, compatibility, or any other outcome.

Other members independently decide whether to view, like, communicate with, block, report, ignore, or meet another user.

KurdSelect does not guarantee that any particular member will respond to you.

You are responsible for your interactions with other users.

To the fullest extent permitted by law, KurdSelect is not responsible for disputes, communications, transactions, representations, conduct, injuries, losses, or other interactions between users occurring through or outside the Services.

KurdSelect may, but is not obligated to, become involved in disputes between users.

Except for User Content and third party materials, KurdSelect and its associated software, branding, logos, designs, interfaces, databases, systems, technology, graphics, text, business rules, and other materials are owned by or licensed to NHRHR Ventures LLC.

The Company's internal documentation provides that the KurdSelect brand, source code, database structures, designs, logos, domain names, app store accounts, business rules, subscription logic, and related company assets are owned or controlled by NHRHR Ventures LLC unless otherwise approved.

You may not copy, reproduce, distribute, sell, license, reverse engineer, scrape, modify, create derivative works from, or commercially exploit KurdSelect intellectual property except as expressly authorized by us or permitted by applicable law.

You may not use bots, crawlers, scrapers, automated scripts, data mining tools, artificial intelligence systems, or similar technology to access, extract, copy, index, collect, monitor, reproduce, or use KurdSelect data or member information without our prior written authorization, except where such restriction is prohibited by applicable law.

You may not use KurdSelect member profiles, photographs, messages, or other User Content to build, train, fine tune, test, or improve artificial intelligence or machine learning systems without authorization from KurdSelect and any other rights holders whose authorization is legally required.

Unless expressly authorized by KurdSelect, you may not use the Services to:

• Advertise products or services
• Recruit users for unrelated businesses
• Sell goods or services
• Solicit investments
• Promote other dating or matchmaking platforms
• Conduct mass marketing
• Harvest contact information
• Send spam
• Operate scams or financial solicitations

KurdSelect is intended primarily for genuine interpersonal connections.

The Services may rely on or link to third party products and services.

Third parties may have separate terms and privacy policies.

KurdSelect is not responsible for independent third party services to the extent permitted by applicable law.

Use of Apple or Google services may also be subject to their respective terms.

You may stop using KurdSelect at any time.

KurdSelect may suspend, restrict, or terminate an account where we reasonably believe:

• These Terms were violated
• The account creates a safety risk
• Fraud or abuse occurred
• The account is fake or deceptive
• The user is under 18
• Another user's rights were violated
• The account circumvents prior enforcement
• Continued access creates legal or security risk
• Suspension or termination is required by law

Serious violations may result in immediate termination without prior warning where permitted by law.

Termination of an account does not automatically create a right to a refund.

Users may request deletion of their KurdSelect account according to the procedures made available through KurdSelect.

Certain information may be retained after deletion where reasonably necessary and permitted by law for:

• Fraud prevention
• Safety
• Preventing banned users from circumventing restrictions
• Financial records
• Legal compliance
• Dispute resolution
• Litigation
• Enforcement of these Terms

Account deletion and subscription cancellation are separate processes.

Our collection and use of personal information is described in the KurdSelect Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference where permitted by applicable law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KURDSELECT AND THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

NHRHR Ventures LLC disclaims warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

We do not warrant that:

• The Services will always be available
• The Services will be error free
• Every profile is accurate
• Every member is who they claim to be
• Users will behave appropriately
• Messages will receive responses
• You will find a compatible partner
• Use of KurdSelect will result in a relationship or marriage
• Every fraudulent or abusive user will be identified before interacting with another user

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NHRHR VENTURES LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF KURDSELECT.

This includes, where legally permissible, losses resulting from:

• User conduct
• Offline meetings
• Unauthorized access
• Service interruption
• Loss of data
• Fraud by another user
• Reliance upon another user's statements
• Emotional distress resulting from user interactions
• Loss of profits or opportunities

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF NHRHR VENTURES LLC ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY FOR KURDSELECT SERVICES DURING THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR US $100.

This limitation does not apply where liability cannot legally be limited or excluded.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless NHRHR Ventures LLC and its members, managers, officers, employees, contractors, agents, affiliates, successors, and service providers from claims, liabilities, losses, damages, judgments, costs, and reasonable legal fees arising from or relating to:

• Your unlawful use of the Services
• Your material violation of these Terms
• User Content you submit
• Your infringement of another person's rights
• Fraudulent or unlawful conduct committed through your account

This obligation does not apply to the extent a claim results from conduct for which KurdSelect cannot lawfully disclaim responsibility.

Except where applicable consumer law requires otherwise, these Terms and disputes concerning them will be governed by the laws of the State of Texas, without regard to conflict of law principles.

Nothing in this section eliminates mandatory consumer rights available under the laws of your place of residence where those rights cannot legally be waived.

Before initiating formal proceedings, you and NHRHR Ventures LLC agree to make a reasonable good faith effort to resolve a dispute informally.

A user may initiate informal resolution by contacting info@KurdSelect.com and describing the dispute and requested resolution.

NHRHR Ventures LLC may contact the user through the contact information associated with the account.

If the dispute cannot be resolved informally, applicable legal remedies remain available subject to these Terms and applicable law.

KurdSelect may modify, add, remove, suspend, or discontinue features as the platform develops.

We may modify free and Premium functionality, provided changes affecting paid subscriptions are handled in accordance with applicable law and marketplace requirements.

KurdSelect does not guarantee that any particular feature will remain available indefinitely.

We may modify these Terms from time to time.

When we do, we will update the Last Updated date.

For material changes, we may provide additional notice through the Services, website, email, or other appropriate means.

Where applicable law requires affirmative consent to updated Terms, we will request that consent.

Continued use of KurdSelect following the effective date of updated Terms constitutes acceptance where legally permitted.

By using KurdSelect, you consent to receive electronic communications necessary to operate your account, subject to applicable law.

These may include:

• Account notices
• Security alerts
• Subscription information
• Transaction notices
• Policy updates
• Safety notices
• Legal notices

Electronic communications may satisfy legal writing requirements where permitted by law.

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed where necessary.

The remaining provisions will remain in effect.

Failure by NHRHR Ventures LLC to enforce a provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

You may not assign or transfer your rights or obligations under these Terms without our written consent.

NHRHR Ventures LLC may assign these Terms as part of a merger, acquisition, financing, restructuring, sale of assets, corporate reorganization, or transfer of the KurdSelect business, subject to applicable law.

These Terms, together with the KurdSelect Privacy Policy and any additional policies or terms expressly incorporated by reference, constitute the agreement between you and NHRHR Ventures LLC concerning your use of KurdSelect, except where separate terms expressly apply.

The Texas Certificate of Formation confirms NHRHR Ventures LLC as the Texas entity, and the Texas Assumed Name Certificate establishes KurdSelect as its assumed name.

BY CREATING A KURDSELECT ACCOUNT OR OTHERWISE USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO THESE TERMS OF SERVICE AND ACKNOWLEDGE THE KURDSELECT PRIVACY POLICY.

Where applicable law requires separate or additional consent, KurdSelect will obtain that consent as required.
